1. Acceptance of Terms
By accessing and using shiftsmart ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Service Description
shiftsmart is a platform that connects customers who need moving and transport services with professional drivers. We facilitate:
- Booking and scheduling of moving services
- Real-time tracking of drivers and shipments
- Secure payment processing
- Communication between customers and drivers
3. User Responsibilities
3.1 For Customers
- Provide accurate pickup and delivery information
- Be present or have a representative at scheduled times
- Ensure items are properly packed and ready for transport
- Disclose any special handling requirements or fragile items
- Complete payment as agreed upon
3.2 For Drivers
- Maintain valid driver's license and vehicle registration
- Ensure vehicle is in good working condition
- Provide professional and courteous service
- Handle items with care and follow safety protocols
- Complete trips as scheduled and communicate any delays
4. Pricing and Payments
All prices are displayed in South African Rand (ZAR) and include:
- Base fare based on truck size and distance
- Fuel costs and wear-and-tear charges
- Optional add-ons (assistants, protective covers, etc.)
- Platform fee (5% of total)
Drivers receive 95% of the earnings. Payments are processed securely through our platform.
5. Cancellation Policy
- Customers may cancel up to 2 hours before scheduled pickup without penalty
- Cancellations within 2 hours may incur a cancellation fee
- Drivers who cancel accepted trips may face account penalties
- Both parties can contact support for extenuating circumstances
6. Liability and Insurance
shiftsmart acts as a platform connecting customers and drivers. While we verify drivers and their insurance:
- Drivers are independent contractors, not employees of shiftsmart
- Each driver maintains their own insurance coverage
- Customers are encouraged to document items before transport
- Claims for damages should be filed with the driver's insurance
7. Prohibited Items
The following items are prohibited from transport:
- Illegal substances or contraband
- Hazardous materials (explosives, flammables, chemicals)
- Firearms and ammunition without proper permits
- Live animals (unless specifically arranged)
- Perishable goods without proper containers
8. Account Termination
shiftsmart reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or receive multiple complaints. Users may also close their accounts at any time through account settings.
9. Dispute Resolution
Any disputes arising from use of the Service shall be resolved through good faith negotiation. If resolution cannot be reached, disputes will be settled through arbitration in accordance with South African law.
10. Changes to Terms
shiftsmart reserves the right to modify these terms at any time. Users will be notified of significant changes via email or platform notification. Continued use of the Service after changes constitutes acceptance of the new terms.
